INTRODUCTION AND COMPLIANCE
Intelligent Telematics latest Haulin' Ass ELD was initially released in 2017 and is complaint
with US Federal FMCSA title 49 part 395 AOBRD 395.15, 395.16 and the latest modifications
to the rule including the current suspension of the two 1AM to 5AM OFF duty periods for
the 34 hours restart.
There is a Certification menu option that indicates that the Haulin' Ass HOS App, ECM
Interpreter and Mobile Devices used are all selfcertified according to FMCSA requirement.
The driver's log file exported by Haulin' Ass HOS App is generated according to the latest
ELD data element dictionary released by FMCSA.
The Haulin Ass HOS App is compliant with the following regulations:
- 60hour/7 days or 70hour/8 days and California 80hour/8 days Rules
- 34 hour week restart with latest suspension of two periods 15am
- 11 hours driving for the day and 12 hours driving for California
- 14 hours on duty for the day and 16 hours of onduty for California
- Sleeper Berth provision
- Passenger Seat provision
- Personal Conveyance provision
- 30 minutes break provision
- Canada Cycle 1 and 2 Regulations
- Location recording for vehicles engine turned on and off, and location recording every
60 minutes if vehicle is moving
- Duty status changes only permitted when the vehicle is at rest (not moving)
- The Haulin' Ass HOS App warns the driver, visually and/or audibly of any malfunction or
possible violations
- When the vehicle is stationary for 5 minutes or more, the Haulin' Ass HOS App will
default to OnDuty Not Driving and the driver must enter the proper status
- Haulin' Ass HOS App automatically performs selftest, as well as a selftest at any point
upon request of an authorized safety official on roadside agent
Haulin' Ass HOS App is not compliant for the following (exclusions):
- Passengercarrying vehicles
- States of Hawaii and Alaska
You may find the California HOS rules in the California Code of Regulations (CCR) under Title
13, Div.2, Chapter 6.5 Article 3, Section 1212 (Driver's HOS) and Section 1212.5 (maximum
driving and onduty time).

ELD MANDATE OVERVIEW

It is important to know that ELD's do not fully automate driver logs. For example, drivers still
have to manually set their duty statuses to "Off Duty", "Sleeper Berth", and so on. They also
have to manually certify their records. Haulin' Ass ELD is a tool to simplify the process of
data collection for a driver's logs.
The Haulin' Ass ECM Interpreter allows your vehicle to communicate with the Haulin' Ass
HOS App over either a wireless (bluetooth) connection or wired (tethered) connection. To
support compliance with the FMCSA'S ELD mandate, it automates the collection of the
following data items:

Vehicle Identification Number (VIN)
Odometer mileage
Engine hours
Engine on/off status
Vehicle inmotion status (RPM and MPH)

These are the only data items from the vehicle's data bus that are used to support
compliance with the ELD mandate.
The VIN is used to automatically associate your records with a specific vehicle. If you move
the Haulin' Ass ECM Interpreter to a different vehicle, it will automatically read the new VIN
and use the new VIN in your logs. The odometer and engine hour readings are used to
automatically fill in fields in your driver logs.
The engine on/off status and vehicle inmotion status are used as triggers to automatically
record events. A record will be automatically added to Haulin' Ass ELD's logs when the
engine is turned on or turned off. When the vehicle's wheel speed exceeds 5 mph, a duty
status of "Driving" will be automatically recorded. If the vehicle is no longer in motion,
Haulin' Ass ELD will automatically record a duty status change to "On Duty Not Driving" after
5 minutes if the driver does not manually change their duty status. When the Haulin' Ass
ELD detects that the vehicle is in motion, the time must be recorded as either Driving,
Personal Use of the commercial vehicle, or a Yard move. As part of the ELD mandate, the
time when the vehicle is in motion cannot be shortened or reassigned to a status of "Off
Duty", "Sleeper Berth", or "On Duty Not Driving".

ELD MALFUNCTIONS:
(Most malfunctions relate to a Diagnostic, but a malfunction is generated when the same
diagnostic occurs for at least 30 minutes in the last 24 hours):

periods of no ECM data that, when added together are more than 30 minutes in the last

(manually) change the date or the time on your ELD

ELD MALFUNCTION
$ 395.22 Motor carrier responsibilitiesIn general. (h) Invehicle information. A motor
carrier must ensure that its drivers possess onboard a commercial motor vehicle an ELD
information packet containing an instruction sheet for the driver describing ELD malfunction
reporting requirements and record keeping procedures during ELD malfunctions.
The following instructions are in accordance with the guidelines set forth in $ 395.34.
How does the driver know if the ELD is malfunctioning?
The ECM linked device is plugged into the truck's diagnostic port with the truck engine
running and the LED light is off and/or the HOS app is unable to connect to the ECM linked
device.
What does the driver need to do if the ELD is malfunctioning?
Immediately contact Haulin' Ass ELD support at 3234335662 or email us at
[email protected] to troubleshoot the issue.
Note the malfunction and provide a written notice to your fleet administrator within 24
hours.
Keep a paper log for that day and until ELD is repaired or replaced. In the event of an
inspection, display the previous 7 days logs from the Haulin' Ass HOS App as explained on
page 11
What does the fleet need to do if the ELD is malfunctioning?
If a motor carrier receives or discovers information concerning the malfunction of an ELD,
the motor carrier must take actions to correct the malfunction of the ELD within 8 days of
discovery of the condition or a driver's notification to the motor carrier, whichever occurs
first
In the event of an ELD malfunction, Haulin' Ass ELD will send a new device upon notification
from a Fleet Administrator.
If a motor carrier needs a time extension, they must notify the FMCSA Division
Administrator for the State of the motor carrier's principal place of business within 5 days
after a driver notifies the motor carrier according to the guidelines set forth in S 395.34
