Malfunction Reporting

 If an ELD Malfunction occurs, the driver must:
1. Note down the ELD device problem and within 24 hours, send a written notice of the defect
to the motor carrier;
2. Unless the driver already has the records or retrieves them from the ELD, reconstruct the
record of duty status (RODS) For the preceding seven
days and the previous 24 hours and record the rods
on graph-grid paper logs or electronic logging
software that complies with 49 CFR 395.8;
3. Until the ELD is repaired and back in compliance,
continue to manually prepare RODS in line with 49
CFR 395.8. After the malfunction, the recording of a
drivers duty on paper logs or electronic logging
software is not permitted to continue for longer than
8 days; a driver who does so runs the danger of being
terminated from service

 If an ELD Malfunction occurs, the motor carrier must:
1. Within eight days of learning about the issue or upon the drivers notification the motor
carrier, whichever comes first repairs, replaces or services the faulty ELD;
2. Until the ELD is back in operation, the driver must maintain the paper record of duty status
(RODS)
